Lawyers Demand Explanation for Delayed Supreme Court Ruling

A team of lawyers representing Kizza Besigye, led by Senior Counsel Martha Karua from Kenya, matched to the Chambers of the Chief Justice today morning to demand a plausible explanation for the Supreme Court’s inordinate delay in disposing of the Attorney General’s appeal.

The appeal challenges the Constitutional Court’s proclamation that the trial of civilians by the General Court Martial is unconstitutional.

The lawyers, who are part of the “battalion” of Besigye lawyers, successfully challenged this practice in the 2016 case of Hon. Kabaziguruka.

The appeal has been pending before the Supreme Court since 2012, notwithstanding the assurance by Justice Owiny Dollo and other Supreme Court Justices that they would render the verdict expeditiously given its significance and urgency.

Unfortunately, the team did not meet with any senior judicial officer, but the Private Secretary to the Chief Justice, Tadius Tumwesigye, promised to convey their concerns and revert in due course.

Lord Mayor of Kampala Erias Lukwago, who is also Kizza Besigye’s lawyer, vowed that they would not waver in their pursuit of justice and civil liberties. “We’ll not waver on pursuit of justice and civil liberties,” Lukwago said.

The delay in disposing of the appeal has raised concerns about the judiciary’s commitment to upholding the rule of law and protecting human rights.

The lawyers’ demand for an explanation is a step towards ensuring that justice is served, and the rights of civilians are protected.
