    UGANDAN COURT DISSOLVES MARRIAGE OF RADIO BOSS AND WIFE AMID DOMESTIC VIOLENCE, INFIDELITY AND WITCHCRAFT CLAIMS

    Kampala, Uganda – The Family Division of the High Court has dissolved the marriage of Brian Mochorwa Mariaria, accountant and boss of Radio One and Akaboozi ku biiri, and his wife Fortunate Komugisha, citing irreconcilable differences.

    Judge Celia Nagawa ruled in favor of Mochorwa, stating:

    “Therefore, I will not hesitate to release whoever wants to leave for a justified cause than to keep a shell house. In the instant case, the Petitioner testified that during the subsistence of the marriage, it was marred with domestic violence, cruelty, and he lived on the edge.”

    Mochorwa had petitioned for divorce, citing a history of domestic violence and infidelity. He testified that Komugisha had deserted their matrimonial home without reasonable excuse, engaging in affairs with other men, including a top UPDF officer.

    Mochorwa also alleged that Komugisha performed witchcraft ceremonies in their home targeting him. He stated:

    “During our honeymoon, she fumed, abused me, and became violent… She even vowed to steal a gun from the UPDF officer friend to kill me, and on several occasions, she threatened to poison me, that’s why I stopped eating any food prepared at home.”

    Additionally, Mochorwa testified that Komugisha neglected their only child, leaving him with her cousin brother, Otterans Tayebwa. He said:

    “I didn’t know the whereabouts of my son until Tayebwa called me, informing me that my son was sick and the wife had disappeared. I found my son very sick, in pain, and in a bad state, dressed in tattered clothes.”

    Despite being served with court documents through her WhatsApp number and the Daily Monitor newspaper, Komugisha failed to file a defense. Consequently, Judge Nagawa based her ruling on Mochorwa’s evidence, dissolving the marriage.

    The judge granted Mochorwa custody of their 11-year-old son, allowing Komugisha to visit once a month until he turns 18.

    Judge Nagawa acknowledged the complexities of divorce proceedings:

    “In divorce proceedings, court deals with people who are often feeling chaotic emotions and powerful passions… If there is to be divorce, the law should not exacerbate the bitterness between the parties.”

    Mochorwa owns a home in Kajjansi and farmland in Wobulenzi, Luwero district. However, he stated in his affidavit that the couple does not share any immovable properties, and therefore, no orders were made regarding property division.
